Digital due process

Digital due process is the application of the principles of due process to the digital world. Due process is the legal requirement that the state must respect all legal rights that are owed to a person. In the context of digital due process, this means that the state must respect the rights of individuals with regard to their digital data and information.

Digital due process rights include the right to know what data is being collected about them, the right to have access to that data, the right to contest its accuracy, and the right to have it deleted.

The digital due process rights of individuals are often enshrined in data protection laws. For example, the European Union’s General Data Protection Regulation (GDPR) provides individuals with a number of digital due process rights, including the right to know what personal data is being collected about them, the right to have that data erased, and the right to object to its processing.
